Residents of Shiro, Alabama, are suing the state Department of Transportation, claiming that the agency’s expansion of highways has led to repeated flooding of their homes.

As Lee Hedgepeth explains in Inside Climate News, “The lawsuit filed in federal court on July 1 alleges that Shiro’s flooding continues to worsen as rainwater erodes land around the United States.”

Although Aldot denied that flooding was the result of discrimination against the community, he agreed to a “voluntary resolution” intended to provide relief to residents by purchasing more public roads to divert stormwater from their homes, few additional detention basins have been made, and the flood continues to affect residents’ homes.

The lawsuit argues that the Flood constitutes acquisition under the Fifth Amendment and in favor of the court to order a case to carry out two cases regarding the mental anguish of using the property and decreasing the value of the property and the resident to compensate for damages, granting damages to the resident and infusing the property of the property.
