Videos of KJ Biermann, 15, having sex with underage family member found on phone, prosecutor claims

KJ Biermann has been accused of having sex with an underage relative in a bombshell, never-before-known revelation from court.

The 15-year-old — who is the son of “Real Housewives of Atlanta” alum Kim Zolciak and retired NFL star Kroy Biermann — appeared in Georgia’s Fulton County Superior Court on Friday.

During the hearing, Deputy District Attorney Caitlin McGillicuddy shockingly revealed that investigators previously found videos on KJ’s cellphone that allegedly depicted him having penetrative sex with a family member under the age of 12.

McGillicuddy claimed there were “multiple encounters” on video that were discovered on the device and that they allegedly showed KJ using “predatory, derogatory” language toward the victim.

“This would now mark the second time he has been charged with an offense of a sexual nature of a very serious kind which involves female victims,” McGillicuddy noted, adding that KJ was previously charged with sexual battery of a victim under the age of 16, which had not been publicly reported until now.

Per McGillicuddy, KJ had been under court supervision since October 2025 following the alleged incident with the family member, which she said was reported in April 2023.

KJ is currently facing seven felony charges, including aggravated sodomy and aggravated sexual battery, stemming from a separate alleged sexual assault involving a female classmate.

The teen’s defense attorney, Jason Sheffield, declined to comment on the new allegation. However, he has consistently denied the allegations made against KJ in the separate sexual battery and sodomy case.

“The fact that he’s been arrested and is being held without bond is a tragedy. He is not only presumed innocent, but is, in fact, innocent,” Sheffield previously told us.

Meanwhile, Judge Melynee Leftridge said Friday that she will decide by Monday whether KJ — who is currently jailed at Atlanta’s Metro Regional Youth Detention Center — will be released on bond.

In his plea for bond, Sheffield told Leftridge, “This has been so traumatizing to [KJ] personally. He is not a boisterous kid. He is somewhat quiet.”

Sheffield asked that his client be released on $65,000 and insisted that Zolciak, 48, would monitor him, as she is at home and not employed at the moment.

McGillicuddy, however, noted that the victim in the sexual battery and sodomy case had suffered “documented physical injury” as a result of the April incident, which she described as “predatory.”

McGillicuddy asked that, if granted, bond be set at $190,000.

A statement from that victim was then read aloud. In it, she begged the judge to “consider [her] safety” before deciding whether to release KJ on bond.

The victim said she has been “living in fear” due to alleged threats that KJ would come after her if he were to be released.

“No matter who these threats came from directly, I cannot just ignore them or assume that nothing will happen,” she wrote. “I am not only scared for myself anymore; I am scared for my family, too. Members of my family have received emails and phone calls because of this situation.”

She added, “The thought of him being released scares me more than I can put into words.”

KJ — who remained emotionless throughout the hearing — had the support of his parents and 29-year-old sister, Brielle Biermann, as they sat in the courtroom gallery.

Zolciak, who looked “stone-faced,” and Brielle arrived and sat together, while a “stressed” Kroy arrived solo and sat in the row in front of them.

Sheffield initially petitioned for KJ’s release last week, highlighting his client’s achievements in the classroom, the community and on the football field.

“The accused turned 15 years old in May. He is a high school student in good standing who has demonstrated strong academic achievement and regularly participates in extracurricular and community-based activities,” Sheffield wrote in the filing.

“He is an accomplished football player who has received scholarship offers based upon his athletic ability.”

Friday’s hearing comes days after an initial hearing was canceled suddenly, with Sheffield later filing a motion to transfer the case to Fulton County Juvenile Court and keep the proceedings confidential.

He argued that KJ “is an adolescent whose development is ongoing,” noting that the aggravated charges against him “carry a mandatory minimum sentence of 25 years in prison” without the possibility of parole.

Sheffield went on to tell Page Six that his client is “expecting to enter not guilty pleas to all charges” during his arraignment on Oct. 14.

KJ — born Kroy Jagger Biermann Jr. — was indicted by a grand jury on Sept. 3 on charges of aggravated child molestation, aggravated sexual battery, aggravated sodomy, three counts of aggravated sexual battery against a child under 16 and false imprisonment.

The charges stem from an alleged incident involving a then-high school freshman — who described herself as KJ’s girlfriend’s “best friend” — on April 23.

According to court documents, the female classmate, 15, accused KJ, who was 14 at the time, of sexually assaulting her at the Life Time Fitness center in Alpharetta, Georgia.

The girl alleged that KJ forced himself on her while in a co-ed sauna and attempted “multiple times to have sexual intercourse with her by trying to pull down her pants,” despite her rejections.

Additionally, she accused KJ of forcing her to provide oral sex before he digitally penetrated her vagina, claiming that when she “finally managed to get away from him … he pulled up his pants and left.”

The next day, after finally telling her family what had allegedly happened, the girl was examined at the Wellstar North Fulton Medical Center. However, no evidence of male DNA was found in her mouth or vagina.

Following his Aug. 17 arrest on the charges related to that incident, KJ was taken to the Metro Regional Youth Detention Center — where detainees are expected to adhere to a strict routine — and held without bond.

Visitation rules at the facility are also quite strict.

“I’m asking the public not to presume the truth of these allegations and to give the families on both sides their space and privacy,” Sheffield previously told us.

KJ’s parents, specifically, have rallied around him during this time, with his mom previously blasting the “reckless and deeply troubling” accusations against her third child.

On Thursday, Page Six obtained exclusive photos of Zolciak arriving at and leaving her home looking “stressed” and “scattered.”

We also obtained exclusive photos of Kroy, who turns 41 Saturday, looking “devastated” following a visit with KJ.

“You could see it in his eyes. He seemed to be in a very somber mood,” an eyewitness told us. “It is what you would expect with the week they’re having and the stakes if KJ doesn’t get bonded out of jail.”

Zolciak and Kroy — who have each moved on romantically amid their contentious divorce — are also parents to son Kash Biermann, 14, and 12-year-old twins Kane and Kaia Biermann.

Kroy previously adopted Zolciak’s eldest two daughters: Brielle — who is still moving forward with her November wedding despite KJ’s circumstances — and Ariana Biermann, 24.
