The accreditation requires state and school leaders to sign a “legal obligation reminder,” which federal funds are conditional on compliance with federal civil rights laws. It also requires compliance with a few pages of legal analysis written by the administration.
“The use of certain DEI practices can violate federal law,” the administration wrote in its acknowledgment, adding that it is illegal to give one race an advantage over another race.
Schools and states using illegal DEI practices may face losses of federal funds, including grants and contracts, by using illegal DEI practices, in accordance with the accreditation, and may be liable under the False Claims Act. In particular, it threatens Title I funds, sending billions of dollars a year to American schools, targeting low-income areas.
The department ordered the state Department of Education to sign the accreditation and collect the accreditation from the school system.
